RouteUp Terms of Service
1. Who we are and what you are agreeing to
RouteUp is made by Melon Labs (ABN 31 267 542 900), a sole trader business based in New South Wales, Australia. By downloading or using RouteUp you agree to these terms. If you do not agree, please do not use the app.
2. Your licence to use the app
We grant you a personal, non-exclusive, non-transferable licence to use RouteUp on devices you own or control, for your own personal use, in line with the rules of the app store you downloaded it from. You may not copy, modify, resell, or reverse engineer the app except where the law expressly allows it.
3. Ads in the free version
RouteUp is free to use, and the free version is paid for by ads supplied by Google AdMob. We do not control which ads appear and we do not endorse them. What Google receives, and how to limit ad personalisation, is set out in the privacy policy. Buying RouteUp Pro removes all ads.
4. RouteUp Pro purchases
RouteUp Pro is a one-time in-app purchase, not a subscription. It removes ads and unlocks the Pro features described in the app at the time of purchase, and stays yours on that store account, including after reinstalling or changing devices (use the app's restore purchases option).
All payments are processed by Apple or Google under their own terms. Refunds are handled by the store you bought through: Apple's "Report a Problem" page or Google Play's refund process. Nothing in this section limits your rights under the Australian Consumer Law or the consumer protection laws that apply where you live.
5. Timetable information can be wrong
RouteUp displays public transport timetable and real-time information derived from Transport for NSW open data, used under the Creative Commons Attribution 4.0 licence. Melon Labs is not affiliated with, or endorsed by, Transport for NSW.
Timetables change, services get cancelled, and real-time predictions can be inaccurate or delayed. The app is a planning aid, not a guarantee. Do not rely on RouteUp as your only source for time-critical travel. Allow margin and check official sources when it matters.
6. Acceptable use
You agree not to misuse the app or the services behind it, including attempting to disrupt our servers, scrape or bulk-download our data feeds, bypass the Pro unlock, or use the app in any unlawful way.
7. Intellectual property
The app, its design, and its content (other than the third-party data credited above) belong to Melon Labs. These terms do not transfer any ownership to you.
8. Disclaimers
The app is provided on an as-is basis. To the extent permitted by law, we do not promise the app will be uninterrupted or error-free, or that the information in it is accurate or complete.
9. Australian Consumer Law
Nothing in these terms excludes, restricts, or modifies any consumer guarantee, right, or remedy under the Australian Consumer Law or any other law that cannot lawfully be excluded. Where our liability can lawfully be limited, it is limited (at our choice) to resupplying the app or paying the cost of resupply.
10. Limitation of liability
To the extent permitted by law, Melon Labs is not liable for indirect or consequential loss arising from your use of the app, including missed connections or travel disruption caused by inaccurate timetable or real-time information. Our total liability for any claim is limited to the amount you paid us for the app in the 12 months before the claim.
11. App store terms
Your use of the app is also subject to the terms of the store you downloaded it from. If you downloaded RouteUp from the Apple App Store: these terms are between you and Melon Labs, not Apple; Apple has no obligation to provide support for the app; and Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
12. Ending these terms
You can stop using the app at any time by deleting it. We may suspend or end your access if you seriously breach these terms. Sections that by their nature should survive (such as disclaimers and liability limits) survive termination.
13. Changes to these terms
We may update these terms from time to time, for example when we add features. The current version always lives at this page with its effective date at the top, and significant changes will be noted in the app's release notes. Continuing to use the app after a change means you accept the updated terms.
14. Governing law
These terms are governed by the laws of New South Wales, Australia, and disputes are subject to the courts there, except where the law of your country of residence gives you rights to something different.
